Background
In 2012 the National REDD+ Coordination Office under the then-Ministry of Forestry and Wildlife1 requested support to the United Nations Collaborative Programme on Reducing Emissions from Deforestation and Forest Degradation in Developing Countries (UN-REDD) in order “to develop a comprehensive gap analysis of the forest related legal framework relevant to REDD+” with the technical support of the Food and Agriculture Organization (FAO), one of the three UN-REDD implementing agencies. Following this analysis, the Ministry of Environment, Water and Natural Resources (now the Ministry of Environment and Natural Resources) of Kenya requested support to the UN-REDD Programme in order to “integrate REDD+ provisions in key legislation under development and review.” This project was launched through an Inception Workshop on February 17, 2015 and has entailed multi-stakeholder processes in analysis of 6 policy and legal texts in their drafting phase – the Climate Change Act, the Forest Act, the Benefit Sharing (Natural Resources) Bill, the Community Land Act, the Climate Change Policy and the National Forest Programme – as well as the drafting and validation of provisions for these. This project aims to integrate REDD+ provisions in Kenya’s key legislation being developed or under reform processes and to make operational the recommendations formulated in the course of the 2013 targeted support project on legal preparedness.
Objectives
Under the General supervision of the FAOR Kenya, in direct supervision of the FAO UN-REDD Regional Adviser in Kenya and in coordination with the REDD+ Governance/Legal Team in FAO’s Rome Headquarters and in close collaboration with the REDD+ Coordination office and Focal Point, and other stakeholders, the main objective of this consultancy will be to ensure that all updates in recently passed key legislation are taken into account in the report analysing the potential of and providing recommendations for integrating REDD+ provisions, and to prepare communication tools for the dissemination of the results of the projects.
Activities
To update the report “Integrating REDD+ provisions in key legislation under development and review in Kenya” and “The assessment of the Policies, Laws and Regulations framework governing Tenure in the context of REDD+ in Kenya” in light of the recent adoption of the Community Land Act and the Forest Management and Conservation Act; and to highlight all legal provisions which could facilitate or hinder the REDD+ process in Kenya, as well as streamline proposals for subsidiary legislation or policies based on identified gaps
Develop a policy brief on the basis of the updated report on the analysis of the integration of REDD+ provisions in key legislation under development and review in Kenya, including recommendations on next steps – including on land administration.
Disseminate the updated report and present the policy brief through a final workshop (NB: Logistical support for the workshop will be provided by the FAO-Kenya office)
Minimum requirements
Master’s degree in natural resources management, forestry, law, policy and land administration or other relevant subject
